New legislation in both England and Wales have tightened the rules on holiday lets being rated non-domestically. Previously in England a property must have been available to let for 140 days of the year, there is now an additional burden that the property be physically let for 70 days. In Wales, the property must be available to let for 252 days and actually let for 182 days.

 

Given the necessity for a holiday lets to be rated non-domestically to receive many of the available reliefs, the stricter criteria establishes new barriers for operators to overcome. The requirement that the holiday let be actually let creates an unfair tax on failure - which is often at no fault of the operator. For example, in a study by Go Compare, it was found that 26% of UK residents are reducing or scrapping their travel plans due to the cost of living crisis.
